​​​Information and Communication Technologies Appeal Tribunal (ICTAT)​​

Jurisdiction​​

Section 39 of the Information and Communication Technologies Act 2001, Section 15 of the Postal Services Act 2002 and Section 52 of the Data Protection Act 2017 provide for a right of appeal before the Information and Communication Technologies Appeal Tribunal known as ICT Appeal Tribunal to any party who feels aggrieved by a decision of the Information and Communication Technologies Authority, the Postal Authority and the Commissioner of the Data Protection Office.

Composition under amended legislations:

The Information and Communication Technologies Appeal Tribunal will be constituted in due course.


​The Information and Communication Technologies Appeal Tribunal shall consist a Chairperson; a Vice-chairperson; and not more than 4 other members.


The Chairperson and Vice-Chairperson shall be appointed by the President acting in accordance with the advice of the Prime Minister, tendered after the Prime Minister has consulted the Leader of the Opposition.

 

The Chairperson and Vice-Chairperson shall be a person who has served as a Judge of the Supreme Court; has served as a Magistrate in Mauritius for a period of not less than 10 years; or has, for an aggregate period of not less than 10 years, served as a Magistrate in Mauritius and has either been a practising barrister or a law officer, or both as a practicing barrister and a law officer.

 

The members shall be appointed by the Minister after consultation with the Prime Minister.

Every appeal shall be lodged within a period of 21 days from the date of notification of the decision to the aggrieved person. But the Tribunal may entertain an appeal after the expiry of the said period of 21 days if it is satisfied that there was sufficient cause for not lodging it within that period.
