Amendments to Road Traffic Act introduce stricter penalties and digital services<\/div>

The Minister of Land Transport, Mr Mahomed Osman Cassam Mahomed, announced, this afternoon during a press conference in Port Louis, sweeping legal reforms and stricter penalties under the Road Traffic (Amendment) Act 2026. The eleven amendments brought to the Road Traffic Act, with eight of them coming into force as from midnight, today, were outlined.<\/p>

These are:<\/p>

– Suspension of driving licence when driving or cycling under the influence of alcohol, drug or intoxicating substance, with the offender\u2019s driving licence to be suspended for a minimum of two months and maximum six months, on conviction. On the first conviction, he will be liable to a fine of not less than Rs 200 000 nor more than Rs 500 000 and to imprisonment for a term not exceeding 5 years. On a second conviction, the offender will be liable to a fine of not less than Rs 500 000 nor more than Rs 1 M and to imprisonment for not less than 12 months nor more than 8 years. In addition, he will be disqualified from holding or obtaining a driving licence in Mauritius for a minimum period of 5 years.<\/p>

  • Where any person causes the death of another person by driving motor vehicle without being the holder of a driving licence, a provisional driving licence or an international driving permit, he shall commit an offence and be on the first conviction, be liable to a fine of not less than Rs 200 000 nor more than Rs 500 000 and to imprisonment for a term not exceeding 5 years. On a second conviction, the offender will be liable to a fine of not less than Rs 500 000 nor more than Rs 1 M and to imprisonment for not less than 12 months nor more than 8 years. In addition, he will be disqualified from holding or obtaining a driving licence in Mauritius for a minimum period of 5 years.<\/li>
  • Any person demonstrating acts of road rage whilst being a road user shall commit an offence and on conviction be liable to a fine of not less than Rs 50 000 nor more than Rs 100 000 and to imprisonment for a term not exceeding 12 months.<\/li>
  • The fines for causing death by dangerous driving have been doubled to Rs 100 000 to Rs 250 000, with imprisonment for a term not more than five years. For a second conviction, the fines are not less than Rs 400 000 nor more than Rs 800 000 with minimum imprisonment of 12 months and maximum term of 8 years.<\/li>
  • Motor vehicle drivers who fail to comply to the arrest of Police officers will be liable on conviction, to a fine of not less than Rs 25 000 nor more than Rs 100 000.<\/li>
  • Using a motor vehicle with an altered silencer where the noise caused by the escape of the exhaust gases is made greater by the alteration will be penalised with a fine of not more than Rs 10 000.<\/li>
  • The fine for an offence of taking part in an unauthorised road race or trial speed between motor vehicles in a public road has been increased to Rs 50 000 \u2013 Rs 100 000.<\/li>
  • Using a handheld mobile phone or handheld interactive communication device whilst driving a motor vehicle or riding a cycle will be considered as an offence.<\/li><\/ul>

    As for the Amendment section 123 AP regarding the Seizure of motor vehicle when driving or cycling under the influence of alcohol, drug or intoxicating substance, and be taken by the Police to a place of safety, the Minister announced that it will be implemented at a later stage. Similarly, the Amendment brought to enable the Safe City cameras to be empowered through the Finance Bill Act to detect road traffic offences, will be implemented later on.<\/p>

    Moreover, the amendment regarding the fact that drivers should be in possession of either his original driving licence or his Digital Driving License (DDL) will come into force as from January 2027.<\/p>

    For his part, the Minister of Information Technology, Communication and Innovation, Dr Avinash Ramtohul, urged all drivers to check whether all information pertaining to their DDL is already available on the KOREK! Application.<\/p>

    He also announced that the Online payment of Fines system applicable for non-penalty point offences, will be launched on 30 October once the law is proclaimed.<\/p>
